Welcome to EscenarioAI ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the EscenarioAI platform, including our browser-based Digital Audio Workstation (DAW), AI-powered audio processing tools, and all related services available at escenarioai.com (collectively, the "Service").
By accessing or using EscenarioAI, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use EscenarioAI. By using the Service, you represent and warrant that you have the legal capacity to enter into a binding agreement.

Your Content: You retain full ownership of all audio files, compositions, stems, and MIDI data you upload or create using EscenarioAI. We claim no ownership over your creative works.
AI-Generated Content: Content generated by our AI tools (text-to-instrument, text-to-drums, mastering presets) is licensed to you for unrestricted commercial and personal use, royalty-free, upon generation.
Our Platform: The EscenarioAI platform, including its interface, algorithms, trained models, trademarks, and documentation, remains our exclusive property.
All fees are non-refundable unless required by applicable law. We reserve the right to adjust pricing with 30 days prior notice.
Due to the computational nature of our AI services, refunds are generally not provided once processing resources have been consumed. However, if you experience a verifiable service failure, contact support within 7 days of the charge for consideration.
Audio files uploaded for processing are temporarily stored on our GPU servers for the duration of the operation. Once processing is complete and you download results, uploaded files are automatically purged within 24 hours. We do not use your audio content to train our models without explicit opt-in consent.
We strive for 99.9% uptime but do not guarantee uninterrupted service. Maintenance windows, GPU queue congestion, and force majeure events may cause temporary interruptions. We will provide reasonable advance notice of planned downtime.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESCENARIOAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOST PROFITS, OR BUSINESS INTERRUPTION.
Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless EscenarioAI, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.
We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may export your data within 30 days of termination notice.
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use after changes constitutes acceptance.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the AAA Commercial Arbitration Rules.
